What counts as fair use and what can you actually steal online?

What counts as fair use and what can you actually steal online?
Ever seen someone get sued for posting a meme or clip? Copyright law’s a minefield, but there’s a way to navigate it without getting wrecked. Fair use exists, but it’s not a free pass—transformative work, commentary, and minimal use help, but commercial use? Big nope.

I once got a takedown for a 10-second clip in a gaming video. Turns out, even short clips can trigger claims if they’re the "heart" of the original. Now I only use clips under 5 seconds with heavy commentary.

What’s your go-to rule for staying safe? Anyone else paranoid about accidental infringement?

But what about when someone reposts an entire article without credit—does that still count as FAIR use?
LI Liesel Schulz 1 month, 1 week ago
this ain't it

HA Hatice Polat 1 month, 1 week ago
that's crazy

i'm trying 2 grasp this "often misunderstood" part, so can you give me a concrete example of how the law is misinterpreted tbh

HA Hatice Ozturk 1 month, 1 week ago
Exactly! CONTEXT really matters not gonna lie
DI Dila Demir 1 month, 1 week ago
Fair use isn’t a free pass to take whatever you want—it’s a legal doctrine with specific conditions, and courts don’t just rubber-stamp ‘I thought it was fine.’ Context matters way more than people realize

steal the vibe, not the pixels. 👀

DI Dila Demir 1 month, 1 week ago
i appreciate your intention liesel, but stealing the vibe can be really subjective and doesn't necessarily prevent people from profiting off the original creator's work, does it idk

LI Liesel Schulz 1 month, 1 week ago
yeah but stealing the vibe isn’t THE same as stealing the actual work lmao

SE Seung Liu 1 month, 1 week ago
Wait, Liesel—what do you mean by "steal the vibe"? like, taking the *feeling* of something but making it your own idk

FU Funmi Bah 1 month, 1 week ago
But what about when the "vibe" is literally the entire creative output? That’s not just stealing pixels, that’s the whole damn painting.

HA Hatice Polat 1 month, 1 week ago
That’s kinda misleading, right?

I get why this feels murky—fair use is one of those things that sounds straightforward until you actually try to apply it. The key isn’t just stealing vs. not stealing, but whether it’s transformative, how much you’re taking, and if it harms the original creator’s market. Like, quoting a paragraph for a review? Probably fine. Posting an entire song as your ringtone? Not so much. It’s all about context, and that’s what trips people up

But what about when the "whole thread" is just three people agreeing w/ each other? Doesn’t that make the joke feel a little hollow? *(edited)*

LE Lei Lim 1 month, 1 week ago
ok but
WU Wulan Tan 1 month, 1 week ago
Fair use isn't a free-for-all—it's got four key factors: purpose, nature, amount, and effect on the market. You can quote or remix stuff for commentary, criticism, or education, but don’t just slap someone else’s art on your merch and call it a day.

I feel like people always get fair use wrong, lol. Just because you're not SELLING something doesn't mean you're not profiting off it, ngl, I've seen bloggers get taken down for "stealing" images online

LE Lei Lim 1 month, 1 week ago
ok this is actually a really good point 😂

FU Funmi Bah 1 month, 1 week ago
Oh sure, "fair use" sounds like a nice legal loophole until you realize it's basically a judge's mood ring. And "stealing online" is just theft with better lighting and worse consequences.

i totally get where you're coming from—it's wild how much gets shared online without a second thought. I once used a photo I thought was free to use for a small blog post, only to get a cease-and-desist email. Moral of the story: when in doubt, assume it's not free

HA Hatice Polat 1 month, 1 week ago
wait, so when you say "steal," do you mean like copying an image for a meme versus using someone's research paper as your own? Because I feel like the line gets really blurry depending on how much you're changing it, right?
6
LI Liesel Schulz 1 month, 1 week ago
wait, so like, if i repost a meme with credit does that make it fair use? or is that still a gray area? i feel like everyone does it but i don’t wanna get in trouble lmao

Oh man, fair use is such a messy gray area—like trying to explain to my grandma why I can’t just screenshot her favorite soap opera and post it on my blog. The law’s got four vague factors, but in practice, it’s whatever a judge feels like that Tuesday

Fair use is just a fancy way of saying 'I hope no one notices.' Good luck with that.

i'm not convinced by the whole 'fair use' concept when it comes to online content - how do you define that, exactly, and who gets to decide what's fair and what's not?

TO Tobi Kone 1 month, 1 week ago
That’s such a tricky balance to navigate—what feels like "borrowing" versus outright stealing can get so murky online. Have you ever run into a situation where you weren’t totally sure if something crossed the line?
29
DI Dila Demir 1 month, 1 week ago
Wait, but how do you even *know* when smth crosses into "stealing"? Like, if I share a meme that’s already been reposted a hundred times, is that technically fair use or just... lazy?
